In Peru, officials convicted of corruption offenses will be banned from working in government agencies

Peru adopted Legislative Decree No. 1243, also known as the "civil death" law (ley de "muerte civil"), which amended the country's Criminal Code and Code of Criminal Procedure.

According to the new wording, the terms of disqualification for crimes against public authority will range from 5 to 20 years. In addition, the criminal law now provides for the possibility of imposing indefinite disqualification if these crimes are committed against public funds, in particular those involved in the implementation of programs to improve the welfare of society, support or promote social inclusion, if the aggregate value of money, property or other benefit exceeds 15 taxes

Crimes against public authority, for the commission of which the penalty of disqualification is increased, include extortion, collusion in public procurement, embezzlement, misappropriation and embezzlement of property, use of official position, all forms of active bribery, passive international bribery, and abuse of authority.

In case of indefinite disqualification, according to the law, there will be no automatic restoration of a person's right to hold a position in state structures. However, the court that sentenced a person convicted of a corruption offense may decide to rehabilitate him or her - but not earlier than after 20 years.

The normative act also provides for the creation of the Unified Register of Convicted Persons with Subsequent Disqualification (Registro Único de Condenados Inhabilitados), which will be maintained by the National Agency for the Management of the Civil Service (Autoridad Nacional de Servicio Civil - SERVIR). The register, according to the legislators, will be public, and state structures connected to the server will have to refer to the information contained therein before making a decision on appointing a person to a position.

The adoption of the law was announced by Pedro Pablo Kuczynski when he took office as president of Peru in July this year as one of the steps to fight corruption.
