It was in 2022 that the idea of creating the register was discussed for the first time with the bill “On Introducing Amendments and Additions to Certain Legal Acts of the Republic of Kazakhstan on Anti-Corruption Matters” containing, among other things, provisions on a publicly accessible register of corrupt actors being drafted in late 2023.
Under the bill, the register will contain information about the individuals convicted of serious and particularly serious crimes, excluding:
- The individuals undertaking intelligence and counterintelligence activities;
- Employees of special and law enforcement public bodies serving in a specific order to perform certain operational tasks and staff secret employees of these bodies.
The information will include:
- Family name, middle name and name of the convicted;
- Place of work and position at the moment of commission of the corruption crime;
- Elements of the corruption crime;
- Details of the indictment;
- Type of punishment imposed.
The basis for inclusion in the register will be the indictment that has entered into legal force.
The exclusion from the register will be possible based on:
- The acquittal that has entered into legal force;
- Cancellation of conviction under the Criminal Code.
The legal act, upon its adoption, will not be retroactive, i.e. only the individuals convicted after its entry into force will be included in the register.
The powers to define the procedure for forming and maintaining the register, in coordination with the authorised authority for legal statistics and special records, as well as to subsequently manage and publish it will rest with the National Anti-Corruption Agency (Сыбайлас жемқорлыққа қарсы іс-қимыл ұлттық агенттігі).
